Want to ditch Cingular? Now’s the time!

December 20, 2006

Frustrated with the service from your Cingular account? Wanna move on over to the greener fields of Verizon, Sprint or T-Mobile?

Now’s your chance! Well…in about a month, anyway…

Cingular logoThanks to a post at Gizmodo (first from the Consumerist), here’s the details how to escape from your service agreement.

It seems that whenever Cingular changes its rates or terms of service in contracts, customers have a 30-day window to leave without paying any termination fees (usually a punitive $200+ fee, otherwise).

What’s the change this time, you may ask? Big Orange is bumping its text message rates from 10 to 15 cents per message. Damn, voting for my American Idol just got pricier!

Here’s the scoop from Gizmodo’s Jason Chen:

Thanks to Cingular’s recent text message bump from 10 cents to 15 cents per message, (dis)loyal customers can now get out of their contracts without fear of penalty.

Starting Jan 21, 2007, you’ll have 30 days to give them a call and break your contract, provided you’re not currently subscribed to an SMS package. Why the generosity? You can thank Cingular’s own policy that allows customers to terminate their service if there’s a change in the contract terms. Upgrading fees from 10 to 15 cents per SMS counts as a change.

Be wary of the details, however, as readers who got out of their Sprint contracts had their contracts reinstated when they continued to use their Sprint phones after cancellation. Be sure to check out the terms first.

Man, that Apple phone can’t come fast enough…..

Thanks to a poster at Slick Dealz, I found the actual clause in the Cingular TOS that lets you escape:

take note of:
“IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE, BEYOND THE LIMITS SET FORTH IN YOUR RATE PLAN BROCHURE, OR IF WE MATERIALLY DECREASE THE GEOGRAPHICAL
AREA IN WHICH YOUR AIRTIME RATE APPLIES (OTHER THAN A TEMPORARY DECREASE FOR REPAIRS OR MAINTENANCE), WE WILL DISCLOSE THE CHANGE AT
LEAST ONE BILLING CYCLE IN ADVANCE (EITHER THROUGH A NOTICE WITH YOUR BILL, A TEXT MESSAGE TO YOUR EQUIPMENT, OR OTHERWISE) AND YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE OR
RETURNING OR PAYING FOR ANY PROMOTIONAL ITEMS, PROVIDED YOUR NOTICE OF TERMINATION IS DELIVERED TO US WITHIN THIRTY (30) DAYS AFTER THE FIRST BILL REFLECTING THE CHANGE.”
